The officers referenced Santa Monica Ordinance 4.55.050, which mandates the maintenance of clear accessways in public areas. The ordinance states: “No person shall block, impede or obstruct, or leave or cause to be left, anything so as to block, impede or obstruct, any beach or park pathway, sidewalk, recreational court or facility, or any entrance, exit or approach to any park building, structure, or recreational court or facility, except as authorized by the City.” This regulation aims to ensure public safety and accessibility, especially in high-traffic areas such as the entrance to the pier.

After a brief but intense exchange, officers warned that continued performance in the restricted zone would result in a citation. Recognizing the need to comply, the street performer ultimately gathered his equipment and shifted a few feet away to a permissible area outside the fire access zone.

The situation drew the attention of onlookers who gathered to observe the interaction, with some expressing support for the street performer’s rights while others showed understanding of the officers’ adherence to public safety protocols. Tensions Flare at Venice Beach: Police Intervene After Altercation Between Street Performer and Resident

On Wednesday, October 2, 2024, Los Angeles Police officers responded to an altercation on the Venice Beach Boardwalk involving a street performer and a local resident. The incident occurred during a live comedy routine, where the resident allegedly took offense to remarks made by the comedian, leading to a physical confrontation. According to the resident, tensions escalated after a previous interaction in which he helped the comedian by purchasing batteries and complimented his performance. However, during a later encounter, the comedian allegedly made offensive comments about the resident's wife during a routine, which led to a verbal exchange. On the morning of the incident, the resident said he approached the performer to mention the batteries, at which point the situation quickly spiraled. The resident admits to reaching for the comedian's microphone, after which the comedian struck him in the mouth, sparking a scuffle. The comedian, however, provided a different perspective. He stated that he never spoke to the resident during the altercation and expressed concern for his safety, citing that Venice Beach has become increasingly unsafe. The comedian claimed that he felt threatened and only hit the resident in self-defense, particularly given his medical condition—he disclosed that he suffers from epilepsy and was worried that the confrontation could trigger a seizure. The comedian felt that the incident was not "mutual combat," as the police concluded, and argued that his actions were purely in defense of his well-being. The comedian also voiced frustration that the resident was not handcuffed or arrested, citing what he perceived as bias on the part of the officers. He believed the resident, who is white, was given preferential treatment. Despite his desire to press charges for assault and battery, the police decided not to file any charges, as the altercation was determined to be mutual combat. The resident sustained a cut on his lip during the altercation, and officers administered first aid at the scene before both parties went their separate ways.

Tensions Flare at Santa Monica Pier: Police Respond to Assault Among Street Performers.

Santa Monica, CA — Police officers were called to the Santa Monica Pier on Saturday, September 14, 2024, following an altercation during the daily street performers' lottery drawing. The incident involved a street performer known as "Xpoz," a breakdancer with LAB HITTERS, who claimed he was pushed and headbutted twice by another performer.

Speaking with Santa Monica Closeup, Xpoz described the incident, stating, "It’s been a long summer. This is the second time I've been assaulted at the lottery." He explained that the altercation began after he voiced his concerns about another performer copying their dance moves, which led to a heated exchange. According to Xpoz, the other performer "got really upset" and threatened to confront him at a future dance event.

Xpoz reported that the situation escalated when the other performer "pushed the code enforcement officer out of the way" before pushing and headbutting him. Despite the physical altercation, Xpoz declined to press charges, saying, "I didn't press charges 'cause he got a kid… God bless that kid."

The police investigated the incident and spoke with both parties involved. No charges were filed, and the situation was de-escalated on-site. The lottery resumed as scheduled, with all performers, including those involved in the altercation, allowed to continue participating.
